Pressure on journalists and civil activists threatens <strong>freedom of speech and human rights<\/strong> in Kazakhstan, and we condemn such measures.<\/p>\n\n\n\n<p>Furthermore, we firmly believe that the current <strong>legislation on combating incitement to discord<\/strong>, particularly <strong>Article 174 of the Criminal Code of Kazakhstan<\/strong>, is ineffective and requires <strong>revision<\/strong>.<\/p>\n\n\n\n<p>Respected international recommendations, such as those of <strong>Article 19<\/strong>, recognized by the <strong>United Nations<\/strong>, advocate for a <strong>more effective approach<\/strong> to regulating hate speech:<\/p>\n\n\n\n<ol>\n<li><strong>Abolition of criminal penalties<\/strong> \u2013 In most cases, civil sanctions should suffice. Criminal prosecution should only be applied in the most severe cases as an <strong>absolute last resort<\/strong>.<\/li>\n\n\n\n<li><strong>Establishing clear criteria for assessing hate speech<\/strong> \u2013 Legislation should include <strong>clear and unambiguous definitions<\/strong>, preventing <strong>Article 174 of the Criminal Code<\/strong> from being misused to <strong>suppress dissent<\/strong>.
